The rental of equipment owned by L’Eubage S.r.l. is governed by these General Rental Conditions, which are fully accepted without reservation upon confirmation of the quotation and/or upon signing of the delivery document (DDT or accompanying invoice), even when collection is carried out by third parties.
These conditions are expressly approved pursuant to former Article 1341, paragraph 2 of the Italian Civil Code.

Accordingly, failure to comply with even one of the clauses and agreements referred to above shall result in termination of the contract.

1.
The rented equipment is tested and ready for its intended use. The Client is nevertheless required to verify the proper functioning of the rented equipment and to promptly notify L’Eubage S.r.l. of any malfunction. Any equipment taken into possession by the Lessee or on their behalf shall be deemed accepted and acknowledged as being in perfect working condition.

The minimum rental period is one (1) day.

The equipment shall be delivered to the Lessee at the premises of L’Eubage S.r.l. and/or delivered on site by van.

L’Eubage S.r.l. shall issue a regular DDT (transport document), a copy of which shall be returned to L’Eubage S.r.l. duly signed by the Lessee or by the person authorized on their behalf to take delivery.

When transportation and use of the equipment are the responsibility of the Lessee, they shall be at the Lessee’s own risk. Upon receipt of the equipment, the Lessee must take out an irrevocable insurance policy covering damage for the full value of the rented equipment. The insurance must cover all transport risks by car, train, ship, and aircraft, as well as all risks of damage due to atmospheric events, accidents, etc., including total loss of the rental.

In the event of loss, deterioration, theft, fire, or any other damage to the equipment, the Lessee must immediately file a report with the local Public Security Authority and send a copy to L’Eubage S.r.l. within 24 hours of the event by registered letter, anticipated by email. The Lessee must also personally contact L’Eubage S.r.l. as soon as possible. L’Eubage S.r.l. may at any time require immediate compensation for the equipment and payment of the relevant rental fees, including downtime. Any malfunction or breakage occurring during the rental period shall be repaired by L’Eubage S.r.l. or by the manufacturer and charged to the Lessee. The Lessee undertakes not to modify, have modified, repair, or have repaired the rented equipment unless expressly authorized in writing by L’Eubage S.r.l.

The Lessee undertakes, either through insurance coverage or personal liability, to compensate for any damage to property or injury to persons—employees or third parties—caused by accidents originating from the rented equipment or its use. The Lessee expressly releases L’Eubage S.r.l. from any and all liability for direct or indirect damages arising from the rental and use of the equipment, even when attributable to L’Eubage S.r.l.

The Lessee undertakes, while remaining fully liable for the value of the equipment and the rental, to inform any third-party creditors taking enforcement or precautionary actions (such as seizure or attachment) that the rented equipment is the property of L’Eubage S.r.l., and to promptly notify L’Eubage S.r.l. of any such actions.

The equipment rented by L’Eubage S.r.l. is prepared in compliance with applicable regulations. The Lessee, who shall carry out installation and connections, including through third parties, must strictly observe safety regulations and assumes full criminal, civil, and fiscal responsibility.

No rental discount or reduction of the rental period shall be granted to the Lessee due to forced immobilization of the equipment not attributable to L’Eubage S.r.l.

15.
In the event of defects or malfunctions of the rented equipment, including hidden defects, the Lessee may only request replacement of the defective part or parts and, if immediate replacement is not possible, substitution with equivalent equipment, without any right to compensation for loss of use. L’Eubage S.r.l. reserves the right to charge the Lessee for repair costs when damage is due to negligence, accidents, or causes attributable to the Lessee or third parties.

L’Eubage S.r.l. assumes no liability for delayed deliveries, malfunctions, or total or partial loss occurring during the use of its equipment, as rental rates are independent of the value or outcome of works produced using the rented equipment. L’Eubage S.r.l. excludes all warranties and any liability for direct or indirect damages suffered by the Lessee or third parties as a result of improper or inefficient functioning of the rented equipment.

17.
All rechargeable batteries are delivered fully charged. L’Eubage S.r.l. therefore declines all responsibility for loss of charge due to travel (static electricity), prolonged inactivity, or extreme temperature variations. The Lessee is required to check battery charge prior to use.

18.
When not collected by L’Eubage S.r.l., the equipment must be returned in efficient condition, orderly, and in perfect working state to the premises of L’Eubage S.r.l. The Lessee or their representative shall be present during inspection of the returned equipment. Equipment returned via carrier shall be deemed received “subject to inspection.” Partial returns of components belonging to the same device are not accepted. Rental days shall be calculated until full and complete return of all components. Any missing item shall be replaced by L’Eubage S.r.l. and charged to the Client at the current list price.

19.
Any delay in returning the equipment shall be considered an extension of the rental period, without prejudice to compensation for additional damages pursuant to Article 1591 of the Italian Civil Code.

21.
No claims regarding invoices shall be accepted after five (5) days from their date of issue.
